I seem to have lost my complete Petrushka tuba part... anyone willing to share (I'm assured by my copyright expert friend that this is fine, as it's not performable on its own)?

The 1911 version or the 1947 revision? The 1947 revision is still in copyright; the 1911 version is in the public domain.

I'd be interested in hearing your copyright expert friend explanation as to how copying the complete tuba part of Petrushka differs from copying the complete tuba part of, say, Fnugg[/b], the VW's Tuba Concerto, or any accompanied tuba solo or work for a brass ensemble.

The "not a performable unit" argument is interesting, however, the copyright of a work extends to both the complete score and the individual parts (which is why publishers typically include a copyright notice on the individual parts), as well as excerpts of individual part (which is why compilers of excerpt books obtain permission to include excerpts of works still under copyright), so I doubt the argument passes muster.

I'm not an expert; but I believe that this falls under some fair use provision where it is not only not performable, but perhaps my playing might fall under "satire"

Regardless, I trust my friend. Otherwise there're a whole slew of orchestras breaking the law at every audition.

Wow. That is so totally not a part of the realm of "fair use." If it was OK under copyright law, the Torchinsky books would still be in print.

all respect to your friend, J.c., but that is not good advice. Orchestras have librarians who deal with permissions all the time.
