I think you are right. I'm not even sure it's all that tacky, given the way it's presented. If copyright law or even good manners prevents people from linking to content on other sites, the whole Internet is in trouble. If anything, I think the seller put in a fair amount of effort to explain that the video is just a good demonstration of cimbasso playing, and is not the specific instrument being sold.
To the extent there is a specific instrument. He imports stuff, and may (?) have one or more of this item on hand, but note that he can also order silver plated etc. As for being careful ... I doubt this is a fraudulent offer, it's fairly likely your cimbasso will arrive in the mail. I did send message about a year ago when I came across them using Wessex Tubas photo on eBay, but had no response. And to be more annoying that photo was marked © Wessex Tubas which they cropped off.
