Self-Defense: there is a county to the east of where I live that, "The man needed killin'," is still a viable defense.

In the early '60's, my Dad represented a guy in a pool hall fight which ended in each man going home to get his shotgun, came back, and one saw the other first and let him have both barrels. Since they broke off the fight, and then came back, he was tried for murder. But because of the reputation of the deceased, the jury gave him 4 years on the lesser charge of manslaughter. He was paroled after two years, went home, and resumed his life with no further incident.

In the same county thirty years later, two good-ol'-boys were in a diner talking about how the prosecutor needed killin' because she wasn't doing her job properly. They were overheard, reported, and charged with conspiracy to commit murder. A friend of mine defended them and the jury found them not guilty. The prosecutor could not get re-elected due to the general bad opinion of the county. I have to be careful, because now she is a circuit judge!!!

I like the "just needed killing" story. I've heard the expression all my life, probably comes from old west films. This is the first I've heard an example of it really being used. In today's society, one must be very careful what you say, orally or on line.
