If any of you paid by credit card, you can do a chargeback and get your money back if the seller is non responsive and goods haven't been delivered in a reasonable time. For what these horns cost, I would have paid by credit card. The chargeback usually wakes a business up quickly.

But why is he not even communicating with others who ordered tubas months ago? It doesn't look good when he makes good for some ppl and completely ignores others. If he has email/text, then there is NO EXCUSE for him not to let others know who are waiting for the tuba they bought.
There are a LOT of scams/frauds these days - especially in this economy - and they are getting craftier every year. Buyer beware :!:

Al is anything but a scanner.
He responds to my emails within a day or two.
He is well aware of who is waiting for what, and doing everything within his means.

He responds to your emails within a day or two - good for you.
How about other people who have no response from him?

I am also interested in other people's experiences because I am trying to solve a problem and I am looking for information that will allow me to do this as gently (but fairly) as possible. That plus the fact that the last thread about this topic got locked up because it was hijacked and went off the deep end a bit.

Thanks to all of the people so far who have PM'd me about this.

Your point is taken, but I don't want to give you the idea that I have been verbally abusing Al this whole time. This is not the case. I know full well that that kind of interaction doesn't produce much value. As I mentioned before I understand the business predicament he is in (as much as I can do), I just have no idea where we stand at any given time. I also know that I am not the only one in this particular boat. I have conducted my communications with him in a professional and courteous manner. So to answer your question, yes quite frankly I am surprised to not be hearing back.

I have done business with a few people here on Tubenet and have had by and large very positive experiences. I also know that Tubenet is a unique community in that it would be very dangerous to conduct business in any kind of abusive way because it would reverberate across the entire tuba community.

Bitching publicly I would define as complaining here without reason other than to vent. As I mentioned I am looking for help on this, and have had a number of valuable conversions in PM as a result of the original thread (again, I thank those people). I don't believe I am overstating my case in any way or passing out bad information. I have gone down the email route, PMs, texts, snail male (yes I tried that one too), and even paypal to try to request the things you have suggested but have come up dry. I am also continuing to do so even now.

I hope this has not lowered my stock with you DP. Like I said, I am a guy in tight spot looking for a solution and any help I can get.

Update:

Got through to Al today. Got the rundown on things and now I understand where it all stands, and where I stand in relation to everything else.

I will try and give some perspective on this unfortunate situation from the other side of the fence. As someone for no financial gain is trying to help Al and his customers out of this bad situation.

It appears to me that Al does not have the horns to supply, or the funds to refund for reasons I do not know. He also seems to be working his butt off to earn money to fulfil his order obligations and is dripping fund to me to fulfil orders sometimes at a financial loss to him.

I do not know why he is not communicating with some, but maybe it is just embarisment and he does not know what to say.

I would ask that you refrain from legal action to make his situation even worst as it is clear he is working to fulfil all orders eventually. I fulfilled two of his orders last week and will another this week...
