Every time this comes up (which is far too often) you have some indignant thing to say about it, but as far as I recall you don't have any stake in it.

Vindication? Good grief. Are you kidding? No, we don't need any "vindication". We aren't grunting cavemen. And we don't need Al bankrupt or in jail. We need him working and continuing to make progress on this situation.

Gosh - you don't wish him anything bad "personally" - JUST BANKRUPTCY! :shock:
Bankruptcy is never a good thing, but sometimes it is the best option. It exists for the benefit of the people who need it. In terms of not being "personal," no, it's not personal. I think the company, Big Bottom Brass, should declare bankruptcy. Whether or not Al has to do that personally is another story, and his personal business is none of mine.

I may have misspoken a bit as well, as there are several types of bankruptcy. Although shutting the doors and liquidating is one option, a Chapter 11 reorganization is another option if there is hope that the business could become profitable again (which sounds possible here). Some companies recover from Chapter 11 and become profitable again. My point was that if the company fell to Chapter 7, people could end up with no tubas and no refunds (which is right where they are right now).

I really want this to turn out well for everyone, but after a certain point, enough is enough, and it's just not going to get better on its own. People deserve instruments or refunds. And if they can't get either of those, they deserve closure.

You are correct, I have no money in this.

Perhaps "vindication" is a bit strong, but the idea is that if there's no instruments, no refunds, and no communication whatsoever, that's not okay. Something needs to happen, and that action should help people feel a little better that 1) its over and 2) its not going to happen to other people.

I don't know who mentioned jail, but that's never been on my mind (we don't have debtors' prisons!). Bankruptcy...well, it's never a good thing, but sometimes just fail.

Al has been in touch and has paid Wessex Tubas to supply two more horns to customers which they have now received.

Despite suffering a whole series of bad luck (most recently injury from car running into the back of him), he does seem to be doing his best to fulfil outstanding orders as his finances allow.

Has anyone heard from Al recently? I've been tied up in this for far too long, and his last communication with me was on Jan 1. I sort of feel bad dredging up old posts, but I am hoping someone has more information than I do. I was told in November that I am the #1 priority for compensation and in January that he's close to closing out his debt to me, but at this rate I feel like that's a straight lie. Someone want to convince me otherwise?

Missouri, yes. Thank you. I did manage to successfully run my tests. The compilation of the research will be happening over the summer. Having money tied up in a horn that never arrived certainly didn't help.

Kiltie, thanks. Hopefully someone has heard SOMEthing.

The last time Al sent me funds to supply outstanding order was last November. I can hardly believe how many outstanding orders he had at the time Big Bottom went under. Every time I think that must be it, another unfortunate customer comes to light!

Chris, let me know what Al owes you and I will try my best to get sufficient payment from him to cover cost to supply.

BTW Al has assured me he will never return to the business of selling tubas.
