She's probably innocent. It's altogether too easy (particularly on Windows machines) to get infected by an email or website, especially when it's hosted in a foreign country.
Hopefully, her conviction will be set aside on appeal.
The school district's IT manager should have been brought under tougher questioning about what he's done to prevent such occurrences.
Heck, Microsoft just released another boatload of patches. Personally (and professionally), I think that anyone who uses Outlook Epxress as their email client should seriously consider alternatives. There is no compelling reason to use Outlook and its vulnerabilities are legend.

Computer dorn is often used as leverage by law enforcement. One very memorable conversation with a law-enforcement agent a few years ago revealed that many executives fear a conviction for possession of computer pornography more than one for fraud. The way most laws are set up, making a dorn case is ridiculously easy. You got the stuff on your computer, you're guilty.
The particular case that was mentioned to me was the CFO of a medium-sized company. It was getting to be apparent that making a case for some funny fiscal goings-on based on seized computer evidence was not getting anywhere. However, the forensic examiner found plenty of dorn on her office computer, so they proceeded to threaten her with a computer dorn conviction if she didn't cooperate.
She rolled over. Better to be convicted and fined for cooking the books than to be nailed as a sex offender.
Said agent confided to me that they knew that it wasn't the CFO who was downloading the dorn, but rather her office manager.

Sad deal. I think she's most likely completely innocent, perhaps even ignorant. After teaching at a public high school for three years, the amount of teachers who have absolutely no clue how to do anything more than use Word and whatever grading program is pre-installed for them is astounding.
The situation itself, however, is probably more common than we think. I once walked into my office, which had somehow been left open, to find three or four students around my computer screen checking out some internet dating site. I can't imagine what kind of ads that place was pimping. I'm just glad big brother wasn't looking over my shoulder at that point.....

Sadly, with many of the parents I have run into in my short time as a teacher, I would not be surprised if the parents were right behind the DA and demanding her head. Many public school parents tend to be short sighted and downright mean. (please note, I said many, not all) Many will hang you out to dry for nothing. A couple of examples. This year I had a parent come into my classroom with the principal in tow screaming that I had given her child a bad grade. She went completely nuts that I was singling her child out and began demanding that I be fired and threatening a lawsuit. When I brought out my gradebook and attendance records, she wasn't fazed by the fact that her little angel had missed three of my classes without an excuse and he had refused to do any of the writing assignments. I had called her and discussed the situation with her on each occasion. She went on to say that the reason he missed class was that he did not like me and she said that it should not affect his grade. Her words were "I don't see how anyone could get that bad of a grade in choir". Her biggest problem was that I kept him off of the honor roll that semester. His grade was an 87%. Luckily, the principal was behind me in this but he did have to do some major damage control to avoid a lawsuit.
Example 2: When my sister was in school, she was having a bad year and was not keeping up in class. My mother and father would always believe and support the teacher before us (great thing in my mind) and if we had a different story from the one the teacher told we better have had some damn good evidence to back it up. But this teacher refused to contact my mother, would not communicate at all and would not let my parents know when there were assignments coming up. He was not helpful in the least even though my parents were on his side. Finally, one of my mom's friends told her to say that the teacher had been touching my sister and that would get him fired and solve everything. Needless to say, my mom was pretty mad about that advice and instead of taking it, she used it as a learning situation to teach us kids that sometimes you have to deal with crappy people and you just have to cope as best you can and keep going or get out of the situation because things do eventually get better and being an a** doesn't usually help.

This whole business is another "wink-wink-nudge-nudge". We have laws criminalizing those unfortunates who get caught with dorn on their systems, yet we're delighted that electronic dorn in the US represents a $12 billion per year business (something like $57 billion worldwide, though accurate estimates are hard to come by).

However - All I could think about when reading the story was my 9th grade earth science teacher that used to find a Playboy centerfold taped to her roll-down screen on a weekly basis (she used an overhead projector all the time and shared a classroom with other teachers).
Based on the criteria of this case should she have been brought up on charges? The centerfolds came down and were destroyed immediatly.
The reaction to this was overkill - chances are the IT folks had been asking for filters and were turned down for years. I bet one was installed within a week.
