I'm interested! BTW... I don't think there will be any copyright problems. Any existing patents will probably be 'design' patents. In order for any copyright violations to exist the Kelly would have to be an exact duplicate.... which is not likely since the medium would now be plastic.Leland wrote:***UPDATE Oct 29***
This weekend, Jim informed me that it should be a couple of months before production is fully underway.
He's been pleasantly surprised by the interest shown here, and has said to contact him for purchase. He'll put together a list of buyers, and will contact everyone once it's ready.

Though it is possible that the plastice PT-50 copies would be legal, I believe Arnold's post(rant) still makes a valid point. When a company(or individual) makes an investment in R&D, they expect to reap the benefits. Along comes someone else, uses their knowledge which was gained during the R&D process and takes profit which morally should have belonged the the entity which developed the idea. When this occurs, it tends to discourage further R&D because the question is then asked as to why one should go to all the trouble. Why not just wait for someone else to do the work and then come along and use THEIR ideas?
All of this assumes that, in the case of the PT-50 copy, it is legal to do so. I am not certain that is true. I am not a lawyer, nor do I play one on TV.
(Please note the disclaimer. I do not wish to be sued for using someone else's idea.) LOL

Copies and originals
There are so many copies of existing mouthpieces already out in brass that this is almost a moot point. How many companies already make copies of the Bach 18 and even number them "18"? At least 5? There are also copies of the Conn Helleberg, the Bach 25 and 24AW, the Schilke Helleberg II that are blatant rip-offs, though some try renaming them to blur the obviousness a bit. Whether right or wrong, copying is a long-established practice.
I know that there's a fair amount of R & D in mouthpiece design, but aren't most modern mouthpieces a result of players' customization efforts becoming popular? A tweaked or experimental mouthpiece gets passed around, gains a following, and is picked up by a company and sold. So often the design comes from musicians rather than the manufacturers.

Having been involved in manufacturing for over 30 years, including a period with my own company... manufacturing and marketing one of my own patented products... I can tell you that this is the way the free enterprise system works. Further, perhaps the Kelly copy might actually help the sales of the PT-50.... kinda like shareware.TubaRay wrote:Though it is possible that the plastice PT-50 copies would be legal, I believe Arnold's post(rant) still makes a valid point. Re: Kelly mpc
Yep! When I bought my Marzan I found that my trusty Bach 18 didn't work too well...very stuffy. As the Kellybergs were (relatively) inexpensive, I got one, tried it, and found it to be a great match for my new horn. After playing for a few weeks and deeming the experiment a success, I went out and bought a new Conn-Helleberg metal mouthpiece, although I still use the Kellybergs...red for last night's community band Christmas concert , green for St. Patricks, punk pink for rock gigs, and glow-in-the-dark for playing naked at home.TubaTinker wrote: Further, perhaps the Kelly copy might actually help the sales of the PT-50.... kinda like shareware.

Re: Kelly mouthpieces
You need to look at your Tubenet profile. You control the way the time is set when you are signed in. I think that Indiana is GMT-6hrs. The adjustment depends on the time zone you are in. Eastern time would be GMT-5, central time is GMT-6.TubaTinker wrote: hmmmmmm.... The messages on the TubeNet I'm seeing are all off one day.
