If it looks like a duck, quacks like a duck and acts like a duck, it must be a duck.

Looks like a legit ad to me. However... it belongs in the Ebay section of the forum.

I'll bet a bit of searching will determine that the seller is a professional musician working in New Orleans.

One of the advantages of buying (potential disadvantage to selling) on ebay is that they have a strong tendency to side with the buyer in disputes.

The buyer should file an "Item not as described" claim, will probably end up with purchase price and shipping refunded.

Sometimes condition is in the eyes of the beholder. I've had some great horns that didn't look so hot.

Ok, maybe I overreacted saying it was terrible, but I was upset. Most of this is cosmetic, but the dents in the main tuning slide and the bent lead pipe really frustrate me. The tuning of the first space Ab is wacky and the entire register above D sucks, and I suspect it's because of the leadpipe.

Yeah... the seller did avoid showing those defects. However... they are fairly easy fixes and the final price seems fair.

As far as the intonation difficulties go... the leadpipe kink might be having some influence but from my personal experience with Eb tubas.... the mouthpiece choice can change a lot.
