I seriously doubt that Mattis gave his permission for the use of his YouTube video in selling this cimbasso.

That's the risk you take when posting things to YouTube...
Re: eBay: Cimbasso
No, that is copyright infringement. It is also unethical and should reflect very poorly on the seller.bort wrote:That's the risk you take when posting things to YouTube...

Re: eBay: Cimbasso
Wait, does copyright on YouTube prevent people from *linking* to the video? I thought it only protected people re-uploading copyrighted videos to another YT account, or uploading copyrighted content from other sources to a YT account. This is merely sharing a link that has been posted for public use. I agree that it's kind of tacky, but I never thought it copyright infringement.
If anything, I think the seller put in a fair amount of effort to explain that the video is just a good demonstration of cimbasso playing, and is not the specific instrument being sold.

I think you are right. I'm not even sure it's all that tacky, given the way it's presented. If copyright law or even good manners prevents people from linking to content on other sites, the whole Internet is in trouble. If what this seller did is somehow not legal or ethical, then it definitely should be.bort wrote:Wait, does copyright on YouTube prevent people from *linking* to the video? Re: eBay: Cimbasso
The second photo is stolen from Wessex Tubas website. I would be very cautious of this seller!

To the extent there is a specific instrument. He imports stuff, and may (?) have one or more of this item on hand, but note that he can also order silver plated etc. As for being careful ... I doubt this is a fraudulent offer, it's fairly likely your cimbasso will arrive in the mail. You might not be completely satisfied with it, but that's less to do with him than Jinbao or whoever.bort wrote:and is not the specific instrument being sold.

It would be especially grievous if something in the picture accounts for the difference between this instrument and one that costs 70% more.ValveSlide wrote:If it bothers him, he should contact them and ask them to remove it.

Re: eBay: Cimbasso

I did send message about a year ago when I came across them using Wessex Tubas photo on eBay, but had no response. And to be more annoying that photo was marked © Wessex Tubas which they cropped off. In my books that is poor business practice and rather indicates someone who just buys in from China with minimal effort (can't even be bothered to take their own photos) and turns out cheap.58mark wrote:This is their website, they seem legit, but Jonathan should ask them to refrain from using his pics

Another example of copyright infringement.Wyvern wrote:I did send message about a year ago when I came across them using Wessex Tubas photo on eBay, but had no response. Re: eBay: Cimbasso
Yes, that definitely is copyright infringement. But again, I still don't see how posting a YouTube link to something is copyright infringement. I'm no lawyer, but the few articles I read about this sound like it has come up before, and has not been considered copyright infringement. Not sure if it being an ebay listing (and possibly from a company) makes it any different, but they sure didn't seem to take the video and claim it as their own (unlike the Wessex photos, which clearly are infringements).
